Prohibition Against Subcontracting with Corporations With Delinquent
Tax Liability or a Felony Conviction under any Federal Law
(a) The subcontractors shall obtain the following certification from
subcontractors at every tier regardless of the dollar amount of the
subcontract and require all subcontractors to flow this requirement down
to all subcontractors with the requirement that it be flowed down the [sic]
their subcontractors: Certification Regarding Delinquent Tax Liability or
a Felony Conviction under any Federal Law
The Offeror represents that –
(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax
liability that has been assessed, for which all judicial and administrative
remedies have been exhausted or have lapsed, and that is not being paid
in a timely manner pursuant to an agreement with the authority
responsible for collecting the tax liability; and
(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal
violation under a Federal law within the preceding twenty-four (24) months.
(b) Unless the award is approved by the MARAD Contracting
Officer, neither the ship manager nor any of its subcontractors at any tier
shall award a subcontract to a proposed subcontractor, regardless of the
dollar amount of the subcontract, where the proposed subcontractor
provides an affirmative response to the above certification, or to FAR
52.209-11 Certification Regarding Delinquent Tax Liability or a Felony
Conviction under any Federal Law.) Any request for approval to award
a subcontract despite an affirmative response shall be referred to the
MARAD Contracting Officer.
